Lofty Drives CIPA Reform to Protect Real Estate Agents from Litigation

PHOENIX, September 2, 2026 – Lofty, an award-winning AI innovator for the real estate industry, today welcomed the California Legislature’s passage of Senate Bill 690 (SB 690), a significant step toward curbing meritless litigation under the California Invasion of Privacy Act (CIPA). 

The bill, which now heads to Governor Gavin Newsom for consideration, addresses a provision of CIPA that has increasingly been used to pursue businesses over commonplace website technologies. If signed into law, SB 690 would eliminate private lawsuits under CIPA’s pen register and trap-and-trace provision for qualifying website, online application, and mobile application activity. 

The development follows Lofty’s aggressive efforts to protect its customers from CIPA-related demands. Earlier this year, Lofty launched its CIPA Defense Program, providing qualifying customers with legal support at no cost rather than leaving real estate professionals to navigate these claims on their own. 

• Lofty also took affirmative legal action to challenge serial CIPA claims targeting the company and its customers.  That action became part of a broader effort among businesses, legal professionals, and other stakeholders to call attention to the growing use of a decades-old privacy law against ordinary modern website technologies. 

  Originally enacted in 1967, CIPA was designed to protect Californians from technologies such as telephone wiretapping and eavesdropping. In recent years, plaintiffs have increasingly attempted to apply provisions of the law to modern digital tools, creating a wave of demand letters and litigation against businesses.

  SB 690 would significantly limit the ability of private plaintiffs to pursue certain claims based on website and application activity. The legislation also includes retroactive protections for qualifying claims filed within two years before the amendments take effect. 

  While the bill awaits the Governor’s signature, its passage marks an important development for businesses facing these types of claims and reinforces Lofty’s commitment to standing behind its technology and its customers.
